2013 Rules and Regulations

1.         “Contest Period” starts at 12:01am on June 14, 2013, up until 11:59 pm on July 7, 2013, the “Contest Closing Date”. To enter,

decorate your Storefront or Website in a Pink theme and keep it decorated  for Paint Canada Pink week until 5:00 pm June 28, 2013.

Posters and other marketing collateral can be obtained by calling the Ottawa Run office Hot Line at 613-738-2873.

Then, take a photo of your store or a Screen Cap of your Website and send it to us at either contests@1053kissfm.com or contests@y101.fm

Encourage your clients to vote for you on-line at either www.1053kissfm.com or www.y101.fm One entry per e-mail address.

The Storefront or Website garnering the most votes up to 11:59pm July 7, 2013 shall be declared the winner.

Then listen to either the New 105.3 KISS FM or Y101.1 FM on Monday July 8, 2013 to see if you have won. Winner will also be contacted by phone.

Submission Period:  Between 12:01am June 14, 2013 and 5:00 pm June 28, 2013 send your photo of your Storefront or the Screen Capture of your Website per the instructions above (the “Submission Period”).

Voting Period:  All entries received during the Submission Period will be voted on by the public between 6:00am July 1, 2013 and 11:59pm July 7, 2013.

2.         No purchase, expenditure or investment necessary to enter this Contest.

3.         This Contest is open to businesses in either Ontario & Quebec. This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement

4.         In order to win, an authorized representative of the selected business must first have correctly answered, unaided, a time limited, mathematical skill testing question posed by telephone. The an authorized representative of the selected business will be required to sign a release and acknowledgment form before being declared the winner. 105.3 KISS FM/Y101 FM judges’ rulings are final and without appeal in all matters related to the Contest and the awarding of the Grand Prizes.

5.         Only two (2) Grand Prizes will be awarded consisting of:

Grand Prize 1: $1,000 in advertising on 105.3 KISS FM or Y101 FM for the Business Storefront with the most votes.

Grand Prize 2: $1,000 in advertising on 105.3 KISS FM or Y101 FM for the Business Website with the most votes.

This advertising will be in addition to any previously booked campaigns on either 105.3 KISS FM or Y101 FM

In the event there is a tie in the number of votes cast, a random draw will be held between the tied entries to determine the selected entrant for a Grand Prize.

6.         The Grand Prizes must be accepted in their entirety and as awarded.

7.         Chances of winning depend upon the total number of businesses registered. Rogers is unaware of how many businesses there may be after registration.  The winner may come from any geographical area so long as they otherwise qualify to enter.

8.         Only one entry per business is allowed. If the identity of a business owner is disputed, the account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant.  The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder.  An entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.  All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

9.         All decisions of the judges are final. 105.3 KISS FM/Y101 FM reserves the right to modify these official rules as necessary.

10.       All entries become property of 105.3 KISS FM/Y101 FM who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the website during the Contest, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion.  105.3 KISS FM/Y101 FM reserves the right, in its sole discretion; to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, 105.3 KISS FM/Y101 FM reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

11.       No correspondence will be entered into except with the selected entrant. 

12.       All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by 105.3 KISS  FM/Y101 FM.  105.3 KISS FM/Y101 FM take no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.

13.       By entering this Contest, each business consents to the use of their entry, name, and city of residence and/or photograph in any publicity carried out by 105.3 KISS FM/Y101 FM and/or its advertising agencies, without further compensation.  Winner consents to their photograph being taken by 105.3 KISS FM/Y101 FM for such use, without further compensation.

14.    105.3 KISS FM/Y101 FM are collecting personal data about entrants for the sole purpose of administering this Contest.  No further informational or marketing communications will be received by the entrant unless the entrant provides 105.3 KISS FM/Y101 FM with explicit permission to do so as indicated on the entry form.  Please see our Privacy Policy at www.rogers.com for full information on the 105.3 KISS F/Y101 FM’s policy towards maintaining the privacy and security of user information.

15.       This Contest will be run in accordance with these rules, subject to amendment by 105.3 KISS FM/Y101 FM  Businesses must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.

16.       The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
